Terms of Service

1.Definitions

• •Service - the Wishdea website and mobile applications together with all their features.
• •User - any natural person who uses the Service, whether or not they have an account.
• •Account - an individual account that lets a User create and manage their own wishlists.
• •Wishlist - a list of gift ideas created by a User and available under an individual address (e.g. wishdea.com/your-name). A Wishlist can be public or private.
• •Guest - a person who views a Wishlist via a shared link and may reserve a gift without holding an Account.
• •Reservation - marking a gift on a Wishlist as taken, so other Guests can see it is no longer available.
• •Follower - a User who follows another User's Wishlist to keep it in their own app.
• •Follow request - a request to follow a private Wishlist, which the owner may approve or reject.

2.The Service

Wishdea lets you create wishlists, add gift ideas (a name, price, link and description), order them by priority and share them through a single link.

Guests can browse a shared Wishlist and reserve gifts. The owner of the Wishlist does not see who made a reservation; other Guests only see that a gift is already taken.

You can also follow another User's public Wishlist to keep it in your own app. If a Wishlist is private, you can ask to follow it and the owner decides whether to approve your request, or you can use a passcode the owner shared with you. We may send you service e-mails related to these actions, for example to confirm a follow request or let you know it was approved.

Using the basic features of the Service is free of charge. We do not sell any of the products shown on Wishlists and we are not a party to any purchase you or a Guest makes in an external shop.

3.Account registration

To create your own Wishlist you need an Account. You register with an e-mail address and a password, and you may choose an individual address (slug) for your list.

• •The Service is intended for people aged 16 or older. If you are younger, you may use it only with the consent of a parent or legal guardian.
• •You must provide accurate data and keep your password confidential. You are responsible for activity carried out through your Account.
• •Each User may hold one Account unless we agree otherwise.
• •Tell us immediately if you suspect that someone has gained unauthorised access to your Account.

4.Rules of use

When using the Service you agree to comply with the law and these Terms. In particular, you must not:

• •post unlawful, offensive, vulgar or rights-infringing content;
• •use the Service to send spam or malware or to phish for other people's data;
• •attempt to gain unauthorised access to the Service, other Accounts or our infrastructure;
• •scrape, overload or disrupt the Service, or circumvent its technical safeguards;
• •impersonate another person or use the Service in a way that misleads others.

5.Your content

You keep all rights to the content you add to your Wishlists. You are solely responsible for that content and confirm that you are entitled to publish it.

By publishing a Wishlist you allow us to store and display it within the Service so that the people you share it with can view it.

We may remove content or restrict access to an Account if it breaches these Terms or the law, after notifying you where reasonably possible.

6.Sharing, following and reservations

• •A public Wishlist is available to anyone who has its link. Treat the link as semi-public and share it only with people you trust.
• •A private Wishlist is not accessible through the link alone. Another User can follow it only after you approve their follow request, or by entering a passcode you set.
• •When you follow a Wishlist or send a follow request, the owner can see that you follow their list and your account identity (such as your e-mail or name). Follow the lists of people you trust, and only accept followers you want.
• •Reservations are anonymous towards the list owner and are meant to prevent duplicate gifts. We do not guarantee that a reserved gift will actually be bought.
• •Links to external shops are provided for convenience. We are not responsible for the availability, price or quality of products in third-party stores.

7.Liability

We make every effort to keep the Service available and working correctly, but we provide it "as is" and cannot guarantee uninterrupted, error-free operation.

To the extent permitted by law, we are not liable for indirect damage, lost gifts, or the conduct of other Users, Guests or external shops. Nothing in these Terms limits liability that cannot be limited under applicable law, including consumer rights.

8.Term and account deletion

• •You may stop using the Service and delete your Account at any time from the app settings or by contacting us.
• •When you delete your Account, your Wishlists and their content are removed from the Service. Some data may be retained for as long as the law allows or requires, for example to defend against claims - see the Privacy Policy.
• •We may suspend or close an Account that seriously or repeatedly breaches these Terms.

9.Complaints

You can submit a complaint about the Service at any time by e-mail to contact@wishdea.com. We aim to respond within 14 days.

10.Changes to these Terms

We may update these Terms, for example when we add features or for legal reasons. We will publish the new version in the Service with a new date, and for significant changes we will ask you to accept them the next time you sign in. If you do not accept the changes, you may stop using the Service and delete your Account.

11.Governing law

These Terms are governed by Polish law. Any disputes will be resolved by the courts having jurisdiction under applicable law. Nothing here deprives you of the protection of the mandatory consumer-protection rules of the country where you live.
